Most Chapter 7 cases are finished in about 3 to 4 months
You don't need to set foot in a courtroom. You don't even need to come to an office. Everything is handled by phone, email, and Zoom — from wherever you are in Northern Illinois.
Free Phone Consultation
You call us — or we call you. No office visit, no pressure, no fee. Dan Springer listens to your situation, answers your questions, and tells you honestly whether Chapter 7 is likely the right fit. If it is, we talk through next steps. If something else might serve you better, he'll say so.
Gathering Your Documents
We tell you exactly what to collect — pay stubs, tax returns, bank statements, a list of debts, and a few other standard items. You send everything by email. We guide you through it at every step, so nothing falls through the cracks. Most people find this easier than they expected.
We Prepare Your Petition
Our firm prepares your complete bankruptcy petition — all the official forms, schedules, and disclosures required by the U.S. Bankruptcy Court for the Northern District of Illinois. We review everything with you, answer your questions, and make sure the numbers are right before anything is filed.
You Sign the Signature Pages
Bankruptcy requires your actual, physical ("wet-ink") signature on several pages — not an electronic one. We mail or arrange drop-off of the signature pages. You sign and return them to us. That's it. Simple.
We File — and Collection Stops Immediately
The moment we file your case with the court, something called the automatic stay goes into effect. By law, creditors must stop — right then. Collection calls stop. Lawsuits are frozen. Wage garnishments stop. Repossessions stop. Foreclosure actions pause. This happens automatically, the instant your case is filed. You don't have to do anything extra.
Already being garnished or sued? The automatic stay can stop those actions too. Learn more about stopping garnishments or stopping creditor calls.
The Court Hearing — Short, Routine, by Zoom
About a month after filing, you attend the "court hearing." This sounds intimidating. It isn't.
It is not a trial. There is no judge. It is a brief, routine meeting with the bankruptcy trustee — a court-appointed official who reviews your paperwork and asks a short set of standard questions under oath. Most court hearings last 5 to 10 minutes.
For cases in the Northern District of Illinois, this meeting is held by Zoom video. You attend from home. We are there with you. Creditors may attend but almost never do.
We help you prepare beforehand so you know exactly what to expect. Most clients tell us afterward it was nothing like they feared.
Your identity is verified over Zoom as part of this process, so bring a valid photo ID and your Social Security card or document.
Your Discharge — A Fresh Start
About 60 days after the court hearing, the court issues your discharge order. This is the legal document that permanently wipes out your qualifying debts — credit cards, medical bills, personal loans, and most other unsecured debt. Creditors can never legally collect those debts again.
From start to finish, most Chapter 7 cases in Rockford and throughout Northern Illinois take roughly 3 to 4 months. Then it's done.
