STEP 2

Gathering Your Documents

We tell you exactly what to collect — pay stubs, tax returns, bank statements, a list of debts, and a few other standard items. You send everything by email. We guide you through it at every step, so nothing falls through the cracks. Most people find this easier than they expected.

STEP 3

We Prepare Your Petition

Our firm prepares your complete bankruptcy petition — all the official forms, schedules, and disclosures required by the U.S. Bankruptcy Court for the Northern District of Illinois. We review everything with you, answer your questions, and make sure the numbers are right before anything is filed.

STEP 4

You Sign the Signature Pages

STEP 6

The Court Hearing — Short, Routine, by Zoom

About a month after filing, you attend the "court hearing." This sounds intimidating. It isn't.

It is not a trial. There is no judge. It is a brief, routine meeting with the bankruptcy trustee — a court-appointed official who reviews your paperwork and asks a short set of standard questions under oath. Most court hearings last 5 to 10 minutes.

For cases in the Northern District of Illinois, this meeting is held by Zoom video. You attend from home. We are there with you. Creditors may attend but almost never do.

Your identity is verified over Zoom as part of this process, so bring a valid photo ID and your Social Security card or document.

STEP 7

Your Discharge — A Fresh Start

About 60 days after the court hearing, the court issues your discharge order. This is the legal document that permanently wipes out your qualifying debts — credit cards, medical bills, personal loans, and most other unsecured debt. Creditors can never legally collect those debts again.

Common Questions About the Chapter 7 Process

Will I lose my house or car?
Many people keep both. Illinois law provides exemptions — protections that allow you to keep property up to certain values. For most people filing Chapter 7 in Rockford and Winnebago County, a home with reasonable equity and a car needed for work can often be protected. It depends on your specific situation, which is exactly what we go through in your free consultation. We do not make promises, but we do give you an honest picture upfront.
Does my employer find out?
Bankruptcy is a public court record, but in practice most employers never learn about it. Your employer is not notified when you file. If a wage garnishment is currently being taken from your paycheck, stopping the garnishment will be visible to your employer — but many clients tell us that is a trade they are glad to make.
